How Does the Michigan District Court Work?

Commonly known as the people’s court, the Michigan District Court is the first trial court that most citizens encounter in civil disputes, traffic violations, and misdemeanor criminal matters (except juvenile delinquencies). However, the District Court has limited jurisdiction and does not handle felony criminal matters or civil claims that exceed $25,000 in damages.

About105 District Courts in Michigan handle legal matters per the Local Court Rules of the District Courts and Michigan Court Rules of 1985. Despite the District Courts’ existence, some Wayne County cities have Municipal Courts that function parallel to the District Courts. In the county, there are 4 Municipal Courts located in the cities of Grosse Pointe, Grosse Pointe Park, Grosse Pointe Farms/Shores, and Grosse Pointe Woods.

Act 236–1961–83 of Michigan’s legislature sanctions the District Courts to hear the following cases:

• Civil suits/actions up to or less than $25,000 in the amount of controversy
• Civil infractions
• Traffic violations
• Landlord-tenant disputes
• Adult criminal cases (misdemeanors)
• Small claims
• Land contract forfeitures
• Ordinance and charter violations

Also, the District Courts conduct preliminary examinations in adult felony criminal cases and have the authority to issue arrest and search warrants, set and accept bail, hold arraignments, pass sentences, and oversee probable cause (pre-exam) conferences. Civil cases where the amount in a claim does not exceed $6,000 are referred to as small claims and are handled by the District Courts’ small claims division, also known as the Small Claims Courts. The Municipal Courts have the same jurisdiction as the District Courts. However, under MCL 730.501, the courts have no jurisdiction over small claims cases and can handle only civil claims up to or less than $3,000.

In both courts, the civil and criminal proceedings differ but follow the rules outlined in Chapter 2: Civil Procedures and Chapter 6: Criminal Procedure of Michigan Court Rules.

Civil actions commence when an aggrieved party (plaintiff) files a claim in the court against another individual, organization, or business (defendant). This complaint may be filed in the county where the incident occurred or where the plaintiff resides. When a complaint is filed, and relevant filing fees are paid, the court issues a summons to the defendant, who must respond by filing an answer in the same court within a specified time. Afterward, follow the discovery process (gathering relevant facts of the case) and the pretrial conference. A case that cannot be settled at pretrial proceeds to trial before a judge or jury. Once a trial is concluded, and the judge or jury reaches a verdict, the court’s decision is entered into the record. However, a party is permitted to appeal this decision to the Circuit Courts within 21 days of judgment. Appeals from the District Courts are under the Circuit Court’s jurisdiction as provided by Section 600.8304 of the state’s legislature.

Criminal proceedings begin when individuals above 17 years old are arraigned before a judge to answer for alleged violations or crimes. In these appearances, individuals are informed of their rights, penalties for convictions, and may be allowed to post bail. For crimes that are misdemeanors, offenders who do not accept plea bargains—reduction of penalties if the defendants plead guilty—are put on trial. A misdemeanor trial consists of a 6-person jury and a presiding judge.

Defendants found guilty are subject to fines, not more than a year in imprisonment, or both. Parties may, however, appeal the courts’ decisions to the Circuit Courts. For crimes that are considered felonies, the court holds preliminary examinations and probable cause conferences to determine if the crimes occurred. When a District/Municipal Court finds an individual to have committed a felony crime, the case is transferred to the Circuit Court for trial. Michigan District/Municipal Courts do not have jurisdiction over felonies.

In Michigan, the membership and qualification for District Court judges are similar to that of the Circuit Courts. The judges hold office for 6-year terms and are appointed at non-partisan elections. The qualifications for being a judge in the court include:

• Being registered and qualified voters of the county;
• Being a licensed attorney with at least five years experience; and
• Being below 70 years of age at the time of elections.

The District Court judges are authorized to appoint attorney magistrates who may handle matters involving bail, arrest warrants, ordinance/charter violations, felony preliminary trials, or small claims. In 2019, the District Courts in Michigan were served by 235 judges.

The Municipal Court judges also serve 6-year terms. Qualifications of judges in the court are outlined in the Michigan Uniform Municipal Court Act; these are similar to the conditions for district Court judges’ appointments. However, judges must run for office in the city where they seek a judgeship. There are four Municipal Court judges in the state of Michigan.

The length of time a civil or criminal case takes in the Municipal or District Courts depends on the type of case and the time necessary to complete case procedures and court proceedings. As there are different types of cases in the court, this number is not specific. In criminal cases, although the state’s statutes reference a defendant’s right to a speedy trial, there are no fixed or indicated time limits on when a case may be disposed of by the court or judgment asserted.

This feature is available on the websites through a case, docket, calendar, or court schedule search tool. Usually, there is no fee attached to view a court’s docket. By entering the first, middle, or last name of a party or a case number, parties may find details of a case, including the name of a party involved in a case, the case number, hearing/trial date, and courtroom where a District Judge will hear the case.
