How Long Do Arrests Stay on Your Record?

An arrest record is part of a person's permanent criminal record. A record custodian will remove it if the individual listed on the record takes steps to have it removed. MCL 780.621 allows someone to get an expungement order for eligible crimes from a court. However, the court cannot expunge convictions set out in MCL 780.621c. Among them are:

  • Convictions for charges involving the sexual abuse of children.
  • Crimes relating to human trafficking.
  • Some traffic infractions.
  • Felonies such as domestic abuse.
  • Second-degree maltreatment of a child.
  • Criminal sexual conduct in the second degree.

However, there are also situations where the record custodian automatically deletes the arrest record. According to Michigan Public Act 193 of 2020, convictions that satisfy specific requirements (and the arrest records accompanying them) will automatically be deleted following a predetermined waiting period. These waiting periods include:

  • Any misdemeanor offense carrying a sentence of fewer than 92 days in jail will have a seven-year waiting period.
  • A maximum of two misdemeanors carrying a sentence of 93 days or more will have a seven-year waiting period.
  • A maximum of four misdemeanors will have a ten-year waiting period.
